PRIVACY AND COOKIES POLICY 

 

1. GUIDING PRINCIPLES 

The FRESH OBSERVATION UNIPESSOAL LDA, with headquarters at Rua do Hospital nº 8, 3250-126 Alvaiázere, NIPC 517397471 (hereinafter “YOMASHI”) is owner of the online platform www.yomashi.pt (hereinafter the “PLATFORM”), and is committed to ensuring the privacy and protection of the personal data of customers and visitors, following all legal and regulatory norms in force. 

This Privacy and Cookies Policy is intended to explain how YOMASHI collects, stores and handles your personal data and other data that may be collected for statistical analysis purposes.  

YOMASHI reserves the right to periodically update and amend its Privacy and Cookie Policy to reflect any changes in the way our customers’ personal data is processed or in legal terms. YOMASHI will display the most recent and current date of the Privacy and Cookie Policy, and you are advised to check it periodically for any updates or changes. 

The main objective of this policy is to consolidate the relationship of trust and proximity between YOMASHI and their customers. It also aims to demonstrate transparency in the treatment of collected data, and to inform all customers of their rights and how they can exercise them as holders of personal data. 

 

2. LEGAL BASIS 

YOMASHI acts in strict compliance with the principles described in this policy, Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable data protection legislation, in all processes involving the processing of personal data. 

“Personal Data” means “Any information relating to an identified or identifiable natural person (“data subject”); An “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier or to one or more factors specific to that natural person’s physical, physiological, genetic, mental, economic, cultural or social identity.” 

 

3. DATA PROTECTION 

We use various measures to ensure the security of the information collected, to protect the personal data collected, to prevent improper use, alteration or access, unauthorized disclosure, loss or destruction. 

As the owner of the data, the customer has the right to know what data has been collected and stored, as well as to change it in the customer area and request the store to export or delete it. 

 

4. COLLECTED DATA 

4.1. Customer registration or purchase

When registering or purchasing on the PLATFORM, the following data is collected: e-mail, telephone, name, address, postal code, city, telephone and VAT number. The data collected through the customer’s purchasing process will be processed automatically and are intended for the processing of reservations, orders or the issuing of invoices.

 

4.2. Newsletter

When subscribing to the YOMASHI Newsletter the following data is collected: name and e-mail. 

 

4.3. Contact Form 

YOMASHI may also request personal data in the contact forms, namely, the name, e-mail and other information that the visitor provides. 

 

4.4. Navigation in the PLATFORM

Also data related to the navigation on the online platform is always collected. Examples of this kind of data are device and browser information, network information, and IP address. 

 

5. PURPOSE OF THE DATA COLLECTED 

Personal data is collected and processed in order to fulfill the following purposes:

 

5.1. Service Provision :

Fulfillment of tax obligations;

Reservation and order handling;

Sending information to the PROVIDER for billing;

Resolution of problems such as cancellation, return or refund of the value of products and/or service according to the law in force;

Customer support: clarification of doubts about services, the operation of YOMASHI or any other issue requested by the client;

Collect cookies in order to facilitate your navigation on the site.

 

5.2. Metrics

The user authorizes YOMASHI: 

Automatically collect data about your computer (e.g. browser used), your connection (e.g. IP address) in order to count accesses and determine usage profiles. This information is collected for statistical purposes and does not allow for individual identification;

Using data to benchmark metrics and analytics of fan flows on match/event days.

 

5.3. Direct Marketing (e.g. e-mail marketing): 

The user authorizes the use of their personal data for marketing actions of YOMASHI and its partners by indicating in the check box “I wish to receive information from YOMASHI and its partners”. 

In order for the customer to be updated on any news at YOMASHI, we may send e-mails and/or sms with commercial communications regarding offers, products or campaigns, as well as thematic content and ticket information. 

For marketing purposes, we at YOMASHI may consider and use certain data such as products viewed, products in “WISHLIST” or left in the abandoned cart. 

Marketing communications are made after and with the prior consent of the customer. 

In any and all cases, YOMASHI seeks to ensure that the information and data collected and used are suitable for the purposes described and do not constitute an invasion of customer privacy.

 

6. WHEN WE COLLECT THE DATA 

Data is collected when there is a customer registration at YOMASHI, signing up for the newsletter, filling out the contact form, registering a reservation or order, or while browsing the online platform. 

 

 

7. WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM? 

The holder of personal data has the right, at any time, to request access, rectification, opposition, export and/or deletion, as well as the right not to be subject to automated decisions. 

The customer can exercise any of these rights with YOMASHI, with the submission of a request sent through the following form.

The client may also file a complaint with the National Commission for Data Protection (CNPD), with headquarters at Av. D. Carlos I, n.º 134, 1º, 1200-651 Lisbon. 

 

8. DATA RETENTION 

YOMASHI is required to retain information for tax purposes and audits in accordance with applicable law. 

YOMASHI keeps your data for {define period} due to specific requirements and practices inherent to YOMASHI and its industry, or until you request that they be deleted from the database. 

You may, at any time, request to access, rectify or delete your personal data using the following form. 

If you register with YOMASHI, you can check, edit or delete your personal information at any time from the customer area in YOMASHI. 

At the customer’s request, YOMASHI may change certain customer data associated with bookings or registered orders. 

 

9. DATA SHARING 

YOMASHI does not give or sell any personal data to any entity other than those necessary for the operation of the service and the purposes mentioned above. Personal data will not be used for any other purpose without the proper consent of the data subject. 

Any third party entity with which customer data may be shared is obligated to use it exclusively as a means of performing the proper operation of its service on behalf of YOMASHI. 

YOMASHI may also disclose personally identifiable information under special circumstances, such as in compliance with court orders requiring it to do so or when certain actions violate the Terms and Conditions of business. 

 

10. COOKIES 

YOMASHI uses cookies on the site, however the cookies used do not collect information that identifies the visitor, but rather on how the visitor interacts with the platform website. The data collected is used for statistical purposes, providing and improving the service and user experience.

11. WHAT TYPES OF COOKIES ARE USED?
